Well that’s up to the judge. The lease agreements are generally able to be broken in the case of a bankruptcy. In this case though the city of Glendale and the NHL will argue that the lease can’t be broken. It depends how the lease was written.

I know of lots of people who got severely shafted by that, especially at companies like PMC-Sierra.. Their stock was at 240 at one point and is now around 10bucks.
It’s not really an issue for people who plan for it, but people who do things like assume they’ll cash out more shares later on to pay the taxes (and the shares crash) or just don’t figure them into their calculations at all get majorly hooped.
The reason why it’s taxed at the purchase price is because that’s when the companies are granting them to you, hence it is income. If you turned them around instantly and sold them for that price, then you’d be ok. But people hold on to them, hoping they’ll climb. The smart move is to sell enough to cover the tax bill ASAP and then hold the rest if you figure they’ll go up.

I don’t even get why it needs to be changed. Really, if you know what you’re doing or feel like taking a risk, you could stand to make a killing because of this. It’s only hurting people because the stocks are/were dropping. If they were going up I don’t think people would be complaining..
